Neutral Conflict Resolution · MASC

For lawyers and professionals

A space for technical, neutral collaboration

Professional support, not a substitute

Neutral Conflict Resolution does not replace the lawyer or the adviser of either party. I conceive my intervention as a complementary instrument, aimed at:

  • unblocking complex disputes
  • reducing the tension between the parties
  • opening up scenarios for agreement
  • bringing independent technical analysis

always from a strictly neutral position.

When is referring a matter useful?

Especially in situations such as:

  • Disputes between partners or shareholders
  • Inheritances and estates blocked by the relationship between the parties
  • Court proceedings that have hardened
  • Negotiations that have failed or grown very tense
  • Clients who need “technical time” before litigating
  • Meeting the prior attempt at MASC (Medios Adecuados de Solución de Controversias)

In many cases a neutral intervention substantially improves the later negotiating position, even where no agreement is reached.

What does the neutral intervention bring the lawyer?

  • A real clarification of positions
  • Objective financial and estate analysis
  • Identification of the underlying interests
  • Time saved in the proceedings
  • Less wear on the client
  • A solid basis for settlement agreements

The lawyer keeps the legal direction of the matter at all times.

Neutrality and professional limits

The neutral intervention is governed by clear principles:

  • No legal or tax advice
  • No representation of any party
  • No drafting of court documents
  • No interference in the legal strategy

The parties can come with their lawyer, consult that lawyer before deciding, and continue or resume court proceedings at any point.

Ways of working together

Confidentiality and legal certainty

  • Confidential interventions
  • Confidentiality of the negotiation and of the documents used, with the exceptions the law provides for
  • Respect for the legal limits of MASC
  • Work that sits alongside court proceedings

The purpose is to create a safe space, not to create procedural risk.

An approach especially suited to

  • Lawyers in civil and commercial law
  • Firms handling complex estate disputes
  • Professionals looking for practical solutions for their clients
  • Advisers who put the preservation of relationships first
  • Lawyers who want the prior attempt to negotiate channelled and documented rigorously

A professional relationship built on trust

The collaboration rests on three pillars:

  • Absolute respect for the role of the lawyer
  • Transparency about the scope of the intervention
  • Real technical neutrality

It is not about “convincing” the parties, but about helping them decide better.

Would you like to weigh whether a particular matter could benefit from a neutral intervention?

The enquiry obliges you to nothing afterwards and does not interfere in the lawyer-client relationship.
