MASC Information Session
Know your options before going to court
Before starting court proceedings, the law provides for the possibility of turning to MASC (Medios Adecuados de Solución de Controversias), the adequate methods of dispute resolution.
The Sesión Informativa MASC (MASC information session) is a first neutral and confidential meeting that lets you see whether there is an alternative, professional and structured route to address a financial or estate dispute, before litigating.
Its purpose is to inform and to guide, not to negotiate or impose solutions.
What is the MASC information session?
The MASC information session is an initial meeting in which a neutral professional explains, clearly and in plain terms:
- What the MASC are
- Which options may apply to the dispute as presented
- What scope, limits and safeguards each route has
- Whether or not it is suitable to move forward with this approach
It does not start a process automatically and it does not oblige anyone to continue.
What is it for?
The MASC information session lets you:
- Identify the MASC route that, where applicable and carried out as the law requires, can document the prior attempt to negotiate
- Learn the alternatives to litigation
- Weigh the advantages, limits and risks of each option
- Take an informed decision, under no obligation to continue
It is a space to understand and to decide, not to negotiate.
What this session is NOT
To avoid any confusion, it is worth making clear that the MASC information session:
- Is not a mediation (mediación)
- Is not a negotiation
- Is not legal advice
- Does not oblige anyone to start a later process
- Does not require the other party to be present
Its function is only to inform and to guide.
How does it run?
The session is structured clearly and in order:
- A general account of the dispute as presented
- An explanation of the MASC routes that may apply
- A general analysis of fit, advantages and limits
- Answers to your questions
- Information on possible later steps (if you wish)
All of it in a confidential, neutral and impartial setting.
Format and duration
- Format: in person in Marbella or online
- Approximate duration: 45 to 60 minutes
- Setting: individual or joint, depending on the case

- Companies
- Professionals
- People who already have a lawyer or an adviser
- People who want to explore their options before going to court
One party alone can request it, with no need for the other to be present.
Neutrality and confidentiality
The session is governed by the principles of:
- Neutrality
- Impartiality
- Confidentiality
What is shared is not used outside the session and it cannot be used as evidence in later court proceedings, save in the cases the law provides for.
What is the next step?
After the session, you decide freely:
- Whether or not to start a process of conciliation (conciliación), assisted negotiation (negociación asistida) or mediation

The decision always belongs to the parties.
